FEATURED ON

Los Angeles has some of the most congested roads in the country. Drivers on the I-405, I-10, I-5, and US-101, and on surface streets such as Sunset, Wilshire, and Santa Monica Boulevards, deal with stop-and-go traffic, hurried lane changes, distracted drivers, and heavy pedestrian and cyclist activity every day.

If a crash left you hurt, a Los Angeles car accident lawyer at Feher Law can take the insurance company off your back and build the claim while you recover. We gather the collision report, medical records, and photos or video, and we identify every insurance policy that may apply, including your own uninsured and underinsured motorist coverage.

Our fee is contingent on a recovery, and the first case review is free.

Key Takeaways

  • Four elements decide the claim. A duty of care under Civil Code 1714, a breach of it, causation, and documented damages. Los Angeles adds a practical problem: heavy traffic means more witnesses but faster-disappearing footage.
  • California does not cap the economic losses or the pain and suffering recoverable in an ordinary car accident case. Under Civil Code 3333, damages measure the harm the wrongdoing caused, including current and future treatment, lost earnings, and pain and suffering.
  • Two deadlines matter after a car crash: two years to sue under Code of Civil Procedure 335.1, and six months for a claim against a public agency under Government Code 911.2.
  • Nothing is owed unless you recover. The case runs on contingency under a written agreement, as Business and Professions Code 6147 requires, so the investigation, experts and filing costs do not come out of your pocket while the claim is open.
  • Feher Law handles these cases on full contingency. You pay nothing unless we win.

Do You Have a Car Accident Case?

You may have a claim if another driver’s negligence caused your crash and you were injured or your car was damaged. Four questions decide it: who was at fault, how badly you were hurt, what insurance is available, and whether you are within the deadline. California uses comparative fault, so you can recover even if you share some blame, as Li v. Yellow Cab Co. (1975) 13 Cal.3d 804 established. We can usually tell you in one call whether the facts support a claim.

What a Car Accident Claim Can Recover

A car accident claim can include:

  • Medical bills, past and future. Past bills are measured by what was paid or owed, under Howell v. Hamilton Meats & Provisions, Inc. (2011) 52 Cal.4th 541.
  • Lost income and loss of earning capacity
  • Pain, suffering, and loss of enjoyment of life
  • Vehicle repair or replacement and rental costs
  • Punitive damages in rare cases such as drunk driving

One limit to know: if you were an uninsured owner or operator, Civil Code 3333.4 generally bars recovery of non-economic damages, with limited exceptions.

Why Acting Fast Protects Your Case

The limit to sue is two years from the crash, and a claim against a public agency must be presented within six months. Missing either date can end the case.

  • Vehicle data and nearby video are often overwritten within weeks
  • Insurers use gaps in treatment to argue injuries were minor
  • The at-fault driver’s insurance information can be hard to confirm later
  • A crash that injured someone may also need to be reported to the DMV within 10 days

What a Los Angeles Car Accident Lawyer Does

A Los Angeles car accident lawyer handles the calls, the paperwork, and the negotiation, and prepares your case for court if the insurer will not be fair. We work with your doctors, document the full cost of your injuries, and advise you about each offer. If you also have a property damage claim, we coordinate it so it does not undercut your injury claim.

What to Do After a Crash

  1. Call 911 if anyone is hurt, and move to safety if you can.
  2. Exchange information with the other driver, including license, plate, and insurance.
  3. Photograph vehicles, damage, skid marks, and the scene.
  4. Get witness names and the police report number.
  5. See a doctor even if you feel fine, since pain can appear later.
  6. Report to your insurer, but do not give a recorded statement to the other driver’s insurer.

The Deadlines After a Los Angeles Crash

The deadline for a car accident injury suit is two years from the crash under Code of Civil Procedure 335.1. If a public vehicle or a public road condition is involved, written notice to the public entity is usually due within six months under Government Code 911.2. Property damage claims have a separate, generally longer deadline.

Evidence in a Car Accident Case

Useful evidence includes the police or CHP report, photos and video, witness statements, medical records, repair estimates, your insurance policy, and the other driver’s information. If you can, save your phone’s photos and any dashcam clip. We request additional evidence, such as event data from the vehicles.

Fractures After a Los Angeles Crash

A fracture can end work, sports, and independence for months. If a Los Angeles crash broke your bones, your claim should include surgery, hardware, therapy, and the chance of arthritis or another operation later.

Collision fractures are often complex: displaced or compound breaks, breaks near joints, or several at once. They may need plates, rods, or screws, followed by long recovery and follow-up care, all of which belong in the claim.

Tell your orthopedic surgeon how the injury happened, keep every imaging study and bill, and call us before you accept an insurer’s offer.

Car Crashes in Los Angeles: The Numbers Behind the Risk

Los Angeles is the largest city in California and consistently ranks among the most collision-dense urban environments in the United States. California Office of Traffic Safety data places Los Angeles County at the top of the state for total collisions, fatal collisions, and injury crashes year after year. The city’s combination of dense freeway corridors (I-405, I-110, I-10, US-101, I-5, I-210), high commuter volumes, heavy commercial truck traffic, and surface-street density across more than 470 square miles produces a traffic injury caseload that materially exceeds any other California municipality. For accident victims, the volume creates both opportunity (multiple defendant pools, sophisticated insurance markets) and complexity (long claim cycles, aggressive carrier representation).

What Causes Los Angeles Collisions

According to the California Office of Traffic Safety’s published collision rankings, Los Angeles consistently ranks at the top of statewide injury-crash rankings, with the LA Police Department reporting more than 50,000 traffic collisions annually inside city limits alone. Los Angeles County as a whole accounts for roughly a quarter of all California fatal traffic collisions. The corridors that drive most of this volume are well-documented: the I-405 from Sherman Oaks through the Sepulveda Pass to LAX, the I-10 across Mid-City, the I-110 through South Los Angeles, the I-5 through East LA, and Sunset, Wilshire, Olympic, Pico, Vermont, and Sepulveda surface arterials. Speed-related crashes, distracted driving, and impaired driving dominate causation in CHP collision-fault data.

Typical Types of Car Accidents in Los Angeles County

Los Angeles experiences a wider variety of collision types than smaller California cities because of the diversity of its road network. High-speed freeway collisions on the 405 and 101 produce the most catastrophic injuries (TBI, spine, multi-system trauma). Surface-street collisions in Downtown, Hollywood, Koreatown, and the Westside produce high volumes of pedestrian-strike and cyclist-strike cases. Intersection T-bone collisions are common across the city’s grid-pattern arterials. Rear-end collisions dominate the stop-and-go freeway traffic that defines the LA commute. Commercial truck collisions concentrate around the Port of Los Angeles, the I-710 corridor, and the warehousing districts of South LA and the Inland Empire border.

Injuries We See in Los Angeles Car Accident Cases

Feher Law’s extensive experience representing car accident victims across Los Angeles County has given us deep insight into the range and severity of injuries the city’s collision patterns produce. We handle catastrophic injury cases (traumatic brain injury, spinal cord injury, multi-system trauma, wrongful death) that cluster around the freeway corridors, as well as the high-volume soft-tissue cervical and lumbar cases that result from stop-and-go traffic on the 405, 10, 110, and 5. The firm’s case results across LA County include the $14.6 million Simone v. Estate of Bruce Jameson catastrophic spine verdict and other significant LA-market recoveries reflecting the full severity range of LA traffic collision injuries.

What Happens After a Los Angeles Car Crash: Reports, Hospitals, and Court

Crashes on Los Angeles freeways are investigated by the California Highway Patrol, and crashes on city streets by the Los Angeles Police Department or another local agency. The collision report from that agency is one of the first documents we obtain. Serious injuries from a Los Angeles crash are often treated at Level I trauma centers such as Los Angeles General Medical Center, Harbor-UCLA Medical Center, Ronald Reagan UCLA Medical Center, and Cedars-Sinai Medical Center. Those records show how the injury happened and what care you will need in the future, which is why we collect them early.

If the insurer will not pay a fair amount, we file suit. Under Code of Civil Procedure 395, a personal injury case can be filed in the county where the injury happened, which for a Los Angeles crash is generally Los Angeles County Superior Court. The deadline is generally two years from the crash under Code of Civil Procedure 335.1, and only six months to present a claim if a city, county, or transit vehicle was involved (Government Code 911.2).

Uninsured and Underinsured Drivers in Los Angeles

California requires drivers to carry at least $30,000 per person, $60,000 per accident, and $15,000 for property damage on policies in force since January 1, 2025 (SB 1107). In a serious Los Angeles crash those limits are often far below the real cost of surgery, rehabilitation, and lost income, and some drivers carry no insurance at all.

That is why your own uninsured and underinsured motorist coverage matters. Insurers must offer it, and it is included in a policy unless the policyholder waived it in writing under Insurance Code 11580.2. If the driver who hit you fled the scene, that coverage may still respond, but your policy sets notice requirements, so report the crash to the police and tell your insurer promptly. We review your policy and every other policy that may apply before any settlement is accepted.

California requires minimum liability limits of $30,000 per person and $60,000 per accident for policies issued or renewed on or after January 1, 2025, which can fall short of serious injuries. Your own uninsured or underinsured motorist coverage may help, and insurers offer it under Insurance Code 11580.2.
Under Civil Code 3333.4, an uninsured owner or operator generally cannot recover non-economic damages, such as pain and suffering, with limited exceptions. You may still recover economic losses, so speak with a lawyer.
