FEATURED ON

Los Angeles has apartment buildings, supermarkets, restaurants, hotels, parking structures, and miles of aging sidewalks, and a fall at any of them can end in a broken hip, wrist, or head injury.

If you were hurt, a Los Angeles slip and fall lawyer at Feher Law can find out who was responsible for the hazard and prove it. We gather the incident report, photos, and surveillance video before they disappear, and we pursue full compensation for your medical care, lost income, and pain and suffering.

You pay no fee unless we win, and your first review costs nothing.

Key Takeaways

  • The type of injury shapes the value: a sprain, a broken wrist or hip, and a spinal cord injury lead to very different claims. We value each one from the medical record and the evidence of fault, not from a chart.
  • Notice is the central issue. Owners must use ordinary care under Civil Code 1714, and proof that an owner broke a safety rule can support a presumption of negligence under Evidence Code 669.
  • If you share some of the fault, your recovery is reduced by your percentage but not eliminated, under Li v. Yellow Cab Co. (1975) 13 Cal.3d 804.
  • On private property the limit to sue is two years (Code of Civil Procedure 335.1). On public property, a written claim must first be filed within six months (Government Code 911.2), a step courts require before a lawsuit.
  • Feher Law handles these cases on full contingency. You pay nothing unless we win.

Fall cases are won or lost on notice: did the owner know, or should the owner have known, about the hazard? Our work focuses there.

  • We send preservation letters for video, inspection logs, incident reports, and maintenance records before they are overwritten.
  • We identify every party who may share responsibility, including owners, tenants, property managers, and contractors.
  • We document your injuries with the doctors who treat them, because falls often cause fractures, head injuries, and spine injuries that develop over time.
  • Trial readiness: insurers evaluate a claim differently when the firm is ready to file.

Why Acting Fast Protects Your Case

Slip and fall suits are due two years from the fall (Code of Civil Procedure 335.1). If the fall was on public property, a written claim is due in six months (Government Code 911.2).

  • Store video is often overwritten within days or weeks
  • The hazard, such as a spill, a loose tile, or a broken step, is usually cleaned or repaired right away
  • Inspection logs and incident reports are easier to obtain when preserved early
  • Witnesses forget the details, and employees leave

What to Do Right After a Fall

  1. Get medical attention even if you feel fine, because falls often cause injuries that appear later.
  2. Report the fall to the owner, manager, or store and ask for an incident report.
  3. Photograph the hazard, your surroundings, and your injuries before conditions change.
  4. Get names of witnesses and employees who responded.
  5. Keep your shoes and clothing as they were.
  6. Hold off on recorded statements and releases until a lawyer has reviewed them.

Filing Deadlines for Fall Claims

The usual deadline is two years from the date of the fall under Code of Civil Procedure 335.1. If the fall happened on public property, such as a city sidewalk, a public building, or a transit stop, a written claim must usually be presented within six months under Government Code 911.2. These dates are different, so tell us right away where you fell.

Evidence in a Fall Case

Evidence in fall cases includes photos and video of the hazard, incident reports, witness names, medical records, the shoes you were wearing, weather conditions, and records of earlier complaints or similar falls at the same place. We ask for the owner’s inspection and maintenance records, which can show whether a reasonable inspection would have found the hazard.

Who Is Responsible for a Fall in Los Angeles

Under Civil Code 1714 and Rowland v. Christian (1968) 69 Cal.2d 108, owners and occupiers of property owe a duty of ordinary care to keep the premises reasonably safe. To recover for a fall, you generally must show the owner knew or should have known about the hazard and had time to fix or warn about it, as Ortega v. K-Mart Corp. (2001) 26 Cal.4th 1200 explains. Responsible parties can include owners, landlords, tenants, property managers, and maintenance contractors.

On a public sidewalk, responsibility can be divided. In the City of Los Angeles, the adjacent property owner is generally responsible for sidewalk repair under Los Angeles Municipal Code 62.104 and Streets and Highways Code 5610, except where street tree roots caused the damage, and the City can also be liable for a dangerous condition of public property under Government Code 835. Under the Willits settlement, the City agreed to spend $1.37 billion over 30 years to repair sidewalks and remove access barriers.

Evidence That Wins Fall Cases in Los Angeles

Photograph the spill, the broken step, or the uneven surface before it is cleaned or repaired, and keep the shoes you were wearing. Ask for the incident report and the names of witnesses and employees, and ask the store or building to preserve its video.

If the insurer will not offer a fair amount, we file suit where the fall happened or where the defendant is based under Code of Civil Procedure 395.

Frequently Asked Questions

Usually the property owner's or business's liability insurer. A claim on public property is made against the public entity, and a claim involving a contractor may involve that contractor's insurer as well.
Proving the owner knew or should have known about the hazard in time to fix it. Without that evidence, an insurer can argue the hazard was new or open and obvious. Video, inspection logs, and earlier complaints are the answer.
Fractures, head and brain injuries, spine and back injuries, shoulder and knee injuries, and soft tissue damage. Some develop over days or weeks.
Get medical attention, report the fall, photograph the hazard, collect witness names, keep your shoes and clothing, and speak with a lawyer before giving a recorded statement.
Possibly. California uses comparative fault, so your recovery is reduced by your share of fault rather than barred, as Li v. Yellow Cab Co. (1975) 13 Cal.3d 804 established. The facts matter, including how visible the hazard was.
Earlier complaints, inspection logs, incident reports for similar falls, employee statements, and evidence that the hazard had been there long enough that a reasonable inspection would have found it.
You may have claims against both the adjacent property owner and the public entity. A claim against a public entity must be presented within six months under Government Code 911.2, so do not delay.
Nothing upfront. Feher Law works on a contingency fee under a written agreement, so you owe no attorney's fee unless we recover money for you.
