California Law Behind LA County Fire Claims
Fire-loss claims in California rest on specific statutes. Health and Safety Code 13007 makes anyone who negligently, or in violation of the law, allows a fire to start or escape liable for the damage it causes, and Public Utilities Code 2106 makes a public utility liable for losses caused by its violation of the law or of a Public Utilities Commission order. Injury claims must generally be filed within two years under Code of Civil Procedure 335.1, property-damage claims within three years under Code of Civil Procedure 338, and any claim against a public entity, including a city or a municipal utility, must first be presented within six months under Government Code 911.2. Recoverable losses are measured by Civil Code 3333, which covers all the detriment the fire proximately caused, including evacuation costs, lost income, and the emotional distress of being displaced. A family that lost a loved one can bring a wrongful death claim under Code of Civil Procedure 377.60.
